and operated by AUDIO-ECSTASY("Audio-Ecstasy/we/us"), whose registered address
is PO Box 551 Hull HU5 5GN. All users of this web site are bound by these terms
and conditions so please read these carefully before going on. Your use of this
site and the information available on this site is subject to the terms and
conditions set out below and by using this site you are acknowledging your consent
to them. Audio-Ecstasy, in its sole discretion, reserves the right to change
these terms and conditions at any time without notice, although any changes
will be posted here. By browsing the web site you accept that you are bound
by the current terms and conditions and notices and we therefore recommend that
you check these each time you revisit the site.

Contract Formation.
When you place an order to purchase a product on our web site, your order is
an offer to purchase those products. We will then send you a confirmatory e-mail
setting out the details of your order. A contract will only come into existence
in respect of each of the products ordered when we send you an e-mail confirming
that we have accepted your order.
Price.
All prices on the web site are inclusive of VAT.
We reserve the right to alter product prices on the web site to reflect any
increase in the cost of the products for reasons beyond our reasonable control,
this may include (but is not limited to) pricing mistakes, tax or other duty
increases.
Whilst we make every effort to ensure that all prices on our web site are accurate
and up to date, sometimes errors do occur and the prices stated are incorrect.
Where the correct price is lower than the one on our web site we will only charge
you the lower amount. If the correct price is in fact higher than the price
on our web site we will either contact you and discuss the pricing error before
we proceed with your order, or notify you of the error and cancel your order.
Prices online may differ from those in stores.
Availability.
When you order an item you see an indication of its availability. These indications
and any dispatch times are estimates only and should not be relied upon as guaranteed.
All items from the Uprising back catalogue are produced to order and we ask
you to allow 28 days for delivery. For these orders we will send you an email
when we receive your order, another one when your order is in production and
finally we'll send you an email to advise when we have dispatched your order.
Items marked as �Usually dispatched within 1-2 days� �Usually dispatched
within 7 days� �Usually dispatched within 2 weeks� and �Usually dispatched within
2-4 weeks�
If the product is listed as "Usually dispatched within 1-2 days�, �Usually dispatched
within 7 days�, �Usually dispatched within 2 weeks� or �Usually dispatched within
2-4 weeks�, this means that we have no stock available in our warehouse and
we will have to order the item from our suppliers. This can take as little as
1-2 days but as it depends on the stock situation at the supplier, this is out
of our control. If we become aware that a product you have ordered is no longer
available or cannot be obtained from our suppliers we will cancel your order
and will let you know by e-mail. Dispatch estimates are for working days.
Items marked as �In stock � usually dispatched within 24 hours�
If the product is listed as "In stock - usually dispatched within 24 hours"
it means that we have stock available in our warehouse and we can usually dispatch
the item within 1 working day of you placing your order.
Availability of limited editions.
Please note that we sell a number of limited edition products, which by their
very nature are limited in number. As such, availability is on a strictly first
come first served basis. Whilst we will endeavor to fulfil your order, once
our supplies are exhausted all outstanding orders will be cancelled and any
monies paid refunded. We will not be responsible for compensating you for any
other losses connected with the purchase of limited edition products.
Delivery and Shipping Policy.
Product prices on our site are exclusive of postage and packing charges. A summary
of these charges are shown when you checkout your order.
We will endeavor to deliver the product(s) to you as soon as possible, in accordance
with our shipping policy and the products' availability as set out on the web
site.
Delivery time scales are as follows: If the product is listed as "Usually dispatched
within 1-2 days�, �Usually dispatched within 7 days�, �Usually dispatched within
2 weeks� or �Usually dispatched within 2-4 weeks�, this means that we have no
stock available in our warehouse and we will have to order the item from our
suppliers. This can take as little as 1-2 days but as it depends on the stock
situation at the supplier, this is out of our control. Dispatch estimates are
for working days. Once these items are in stock at our warehouse we will dispatch
them within 24 hours.
Deliveries will be made to the address that you give us for delivery of the
product(s).
If you change your mind.
You may cancel your order for any reason at any time up to the end of the seventh
day after you have received the goods. If you do wish to cancel, the following
terms will apply:
If we have not yet dispatched the product, you may cancel your order by notifying
us by email at sales@audio-ecstasy.co.uk quoting the order reference number.
If we have allocated product to your order or already dispatched it then you
will need to cancel the order by waiting until you receive the item(s) and then
following the instructions on the Despatch Note which is sent with your order,
and return the item(s) to us. We will then process your return and issue a refund
or replacement as appropriate. Please note that your right to cancel does not
apply to any product which you have unsealed from the packaging in which it
was supplied.
If you are wishing to return products because they are faulty please see the
'Returns' paragraph below.
Returns
We hope that all of our customers are happy with their purchases. If any product
we deliver is not what you ordered or is defective or damaged, please let our
Customer Service Department know as soon as possible and we will provide a refund
or replacement in accordance with our Returns Policy.
If you wish to return any item(s) from your order please fill out the back of
the Despatch Note which is sent with all orders, detailing your reasons for
return. You can then send the package back to us using the address provided.
We will issue a refund or replacement as appropriate. We will reimburse the
cost of postage where appropriate.
For any item(s) which are defective, damaged or sent in error by us, we will
refund the cost of the item(s) plus the cost of any postage charges paid by
you as part of your initial order. If you require a replacement we will send
this to you free of charge.
For items which are no longer wanted we will refund the cost of the item but
we will not refund any postage charges paid by you as part of your initial order.
We will not issue any refunds where the item has been removed from its sealed
packaging.
Please note that items must be returned within 14 days of receipt in order for
them to qualify for a refund.

Limitation of Liability
We will only be liable for losses which are foreseeable to both you and to us
as a consequence of us breaching these terms and caused by our own negligence.
We will not be responsible for any commercial or business losses (including
without limit, loss of goodwill, profits, contracts, anticipated savings, data,
or wasted expenditure) or any other indirect or consequential loss that was
not reasonably foreseeable to both you and us at the time our contract was formed,
or at the time you began using the web site.
Nothing in these terms shall affect your statutory rights. If you have any doubts
as to your statutory rights then you should contact your Local Citizens Advice

to you in respect of such sites or any goods or services you may obtain from
them. These web sites may collect data or solicit personal information from

When you place an order, we need to know your name, e-mail address and delivery
address.
Your credit or debit card details will be obtained when you enter your card
details to make your order. These are held on a secure server by Pay Pal who
will responsible for debiting the correct amount from your card. This allows
your order to be processed and fulfilled and permits us to track your order
status. We also ask for your telephone number and Email address, which enables
us to contact you urgently if there is a problem with your order.
When you enter a competition or other promotional feature, we will ask for your
name, address and e-mail address so we can administer the competition and notify
winners. We may use your personal information for our internal marketing and
demographic studies, so we can consistently improve our site to better meet
our visitors� needs.
